Grieving the loss of a loved one and, at the same time, dealing with the choices and financial challenges following a death, can be overwhelming. If you fail to set out clearly whether you want to be buried in a plot, cremated, or sent to your family’s out of state mausoleum, your loved ones will be left with, not only, your loss, but additional problems at this difficulttime.Passing away without a Dispositionof Final Remains Document may lead to disputes between family members if you haven’t provided them with clear instructions detailing who is to be in charge of you remains upon your demise and what your instructions are. Upon your death, if you do not have this document, your surviving spouse would be the first person designated to make the decisions for your remains. But if you are not survived by a spouse, then your children would be called upon to jointly make the decision. Needless to say, having a number of people jointly making decisions while they are mourning,is ripe for emotions getting out of control. In this estate planning document, you can designate the person, and alternate persons, who will make your decisions for your remains. Even if you have already paid for your funeral arrangements, there is always something extra – an extra charge – or an extra decision to be made, and the person you designate will be able to handle that without conferring with and agreeing with the entire family. Show your loved ones how much you care about them by making your wishes known in a Dispositionof Final Remains Document.Kathleen Cassidy Goodman is an attorney in areas of estate planning, probate, civil litigation, and business law.
