It is part of our daily lives and is such a normal part of our day.We often check Facebook, Instagram or Tik Tok without even thinking about it. While it seems so innocent to post a picture from your night out with friends, it could be the thing your ex is waiting for to help their custody case.Social Media and court cases do not mix. I advise my clients not to post anything about their case, derogatory comments about their ex, pics of their new significant other or anything that happened in court. Social media Is not the place to fight your divorce or custody case. Social media is definitely not the place to vent about your ex or their new partner. Your case can be affected by the things you post on social media. Social media posts can be produced at hearings, depositions, and trials as evidence.Posting on social media during your case about your life, kids, wins and losses can give fodder to the other parent. Most courts will order that the parties can’t disparage each other. This can include making derogatory remarks on social media.Posting the outcome of your hearing is also not advisable. Do not tag your ex, their family, your attorney, opposing counsel or the judge in a post where you are complaining about the court’s ruling. Do not post a copy of your court papers or the judge’s ruling, this will only create more tension and chaos.If a party deletes their social media page,VBy Linda Robinsonalentine’s day. I was awkward and loud thru middle and high school, so let’s say I was more disappointed than not. During that time, Valentine’s Day would remind me I was alone on February 14th (this is before Galantine’s Day and just before Girl Power was invented).I married and then was able to celebrate it every year without fear. This means that you should always be aware of what you post, because it’s likely it can be used against you. Like social media posts, texts, emails, voicemails, and recorded phone calls are admissible if between the parties. My advice Is to be very careful what you post, comment on, and text to the other party. The point of Valentines (in my mind) is to take the time to show someone you care for them and spread a little happiness.
