Under Texas law, absent extraordinary circumstances, in order to probate your Will the Court will need your Original Will and not a copy. This means you need to keep your Original Will in a safe place – but not too safe. Your family or your Executor needs to be able to locate your Original Will in order to probate your estate.The safest place to store your Will is undoubtably to place your Will in safekeeping with the local Probate Court. However, the downside is that if you want to change your Will, you need to go in person to the Court, present your identification, and request the Will. If you anticipate making changes to your Will, it is not recommended that you place your Will in safekeeping with the Court.However, it is highly recommended that you do put your Will in safekeeping with the Court if you are excluding a family member who may have access to your home. In the event the excluded family member comes to visit, this family member may discover your Will, destroy it, and receive a share of your estate under the Texas intestacy laws.There are other options. You could place your Will in a safe deposit box with a financial institution.
