When a child is born, someone moves, divorces, remarries, or loses a loved one, it is a good time to check your Will or Estate Plan to determine if changes are in order. Dramatic life changes can have dramatic effects on your estate and your plans regarding the distribution of your assets upon you death.If your spouse has passed away, you may want to re-think the situation. If your children are now grown and financially secure, you may want to designate a portion of your estate to a charity, a friend, or a grandchild. Similarly, if you created a Will when your children were minors, it is time to move them from the position of being cared for by their aunt and uncle into being an Executor or Trustee of your Will or Trust. If you and your new spouse commit your wishes regarding your property in a Will or Trust, you and your family members will avoid the harsh intestacy laws involving real and separate property.Similarity, if you and your spouse have a new baby, you need to prepare a Will in the event both you and your spouse are not around to raise the baby. In a Will, you can designate your desires regarding, not only, who will raise your child, but who will manage the financial assets you leave for them. The individual you name will be the person responsible to distribute money to your child until adulthood.
