In today’s virtual world, an inappropriate picture could cost you your family law case. I always caution my clients to not post anything about their case on social media.Custody cases get contentious very quickly. Pictures, comments and even memes can be used against you. Be aware of what you are posting. I never advise a client to delete their posts or social media account, because doing this is unethical and could be destroying or hiding evidence. If you have embarrassing or inappropriate posts, you need to let your attorney know immediately. It is much easier to handle this when we know at the beginning and are not finding out during a court hearing.One of the most important things I tell my clients is to not try their family law case on social media or by text messages. Everything that you say, and text can be usedagainstyou. Ihaveseentextmessages and emails hold a lot of weight with a judge. Pictures and videos can be introduced into evidence as well. These types of evidence go a long way when a client testifies one way and the pictures/video show the opposite. On the flip side, if you are on the receiving end of threating texts and voicemails you need to produce these to your lawyer who can determine if they are helpful to your case.It is always interesting when a party claims they are not having an affair and the other party produces photographicy Crista Branch, Attorneyevidence from social media of the boyfriend/girlfriend. I have been successful in having a court order that the child’s social media accounts be produced to show acts of parental alienation.If you are going through a divorce or custody case, you don’t have to stop posting but you do have to think about what you post. You need the Wi-Fi because that’s how you listen to your music. You attempt to get someone who works there to assist you however; no one is in sight. You NEED your music to power through your workout. What do you do? If you said go home, wrong answer! That plan may not have worked out however, you are already out the house. You can walk the parking lot / area where the gym is located making the curbs and benches your equipment. You can do laps and strength or power intervals between laps. You still get in some activity and got to listen to your music.Win, win. Another example, you ranout the house and forget your snacks and water bottlein thehouse. Yourememberjust as youapproachfast food row. However, you planned for these moments. You reach into your stash of whatever snack that you keep in the car and grab a reserve bottle of water. You planned to have your own huge water bottle and protein shake post workout. Now you don’t have it. You were tempted to pull into a drive thru. However, you are prepared and aren’t forced to make a bad choice because you are prepared. The plan may have derailed however, your goals didn’t go with it.
