The only thing you can modify in a divorce decree is custody, possession and access and child support. This means anything dealing with money, property, retirement, or anything non-child related cannot be amended or modified. It is very important that the final decree of divorce states how all of the property is being divided. During your divorce case, discovery will be conducted, wherein all bank accounts, credit card statements, loans, retirement accounts, etc. are asked to be identified and documents to be produced. Discovery is an important step of a divorce case. This is where we can see all the bank accounts that are in your spouse’s name. We can see any withdrawals that are being made or transfers going in and out of the accounts that you may not be aware of. Discovery also allows us to ask for all documents that are pertinent to your case and to be produced so there are no surprises at trial. If your ex does not produce these requested documents, then they may not be able to produce at trial.Discovery allow us to see all the assetsand liabilities so we can make sure that nothing gets missed. Many people find out about bank accounts, retirement accounts and credit card debt that their spouse has that they didn’t know about during discovery. Since the law does not allow for the divorce decree to be amended or modified, it is very important that you let your attorney know about all your assets and debt and produce all the documents requested by the attorney.Way too often, someone comes in my office saying that they didn’t get a portion of their spouse’s retirement, and they want to go after it after the orders were signed.
