v Family Matters v “Waiver of Citation – Part 1: What is aWaiver of Service?”WBy Brooke Irey, Attorneyhen a lawsuit is filed, be it a divorce or another civil matter, the petitioning party must“serve” the responding party with a copy of the initial pleading. “Service” in this capacity may be performed by a sheriff of the county personally serving a party, by certified mail through the county’s district clerk, or by personal service through a private process server. You’ve probably seen this last method in a movie or tv show. One man in plain clothes walks up to another man and hands him an envelope saying, “you’ve been served,”and then walks away.But another common method we can use in the law, and which is far more liked by many clients, is the waiver of service. This is a document that we prepare at the same time we prepare an original petition. Once we get the clerked-stamped copy of the petition back after filing, we send a copy of this stamped document, along with the waiver of service to the opposing party. We may choose to send by regular USPS mail, but the far more common way is by email. It’s that simple. We will then file the waiver with the district clerk and the lawsuit may proceed forward without one party having to ever go through the embarrassment of being “served” by another individual.Now, sometimes these waivers may contain additional terms asking the signing party to waive more than just his/her right to service. This is not necessarily a bad thing, but it can be problematic in some instances.
