v Family Matters vMBy Brooke Irey, Attorneyany people often ask about amending or modifying their divorce decrees after they areentered. The only thing you can modify in a divorce decree is custody, possession and access and child support. This means anything dealing with money, property, retirement, or anything non-child related cannot be amended or modified. It is very important that the final decree of divorce states how all of the property is being divided. During your divorce case, discovery will be conducted, wherein all bank accounts, credit card statements, loans, retirement accounts, etc. are asked to be identified and documents to be produced. Discovery is an important step of a divorce case. This is where we can see all the bank accounts that are in your spouse’s name. We can see any withdrawals that are being made or transfers going in and out of the accounts that you may not be aware of. Discovery also allows us to ask for all documents that are pertinent to your case and to be produced so there are no surprisesattrial. Ifyourexdoesnotproduce these requested documents, then they may not be able to produce at trial.Discovery allow us to see all the assets and liabilities so we can make sure that33855 Blanco Road Bulverde, TX 78163(830) 438-4425Book Your Holiday Event!Full-Service Bar • Live Music Indoor & Outdoor Seating Food Truck ServicePet & Kid FriendlyHoliday Special!50% offSECOND DRINKwith this AD!www.thatplaceob.comEXPIRES 1-31-25Happy Holidays!Kathleen Banse830-438-7025 www.kathleenbanse.comnothing gets missed. Many people find out about bank accounts, retirement accounts and credit card debt that their spouse has that they didn’t know about during discovery. Since the law does not allow for the divorce decree to be amended or modified, it is very important that you let your attorney know about all your assets and debt and produce all the documents requested by the attorney.Way too often, someone comes in my office saying that they didn’t get a portion of their spouse’s retirement, and they want to go after it after the orders were signed. Almost all the time, they knew about retirement, but for some reason didn’t include it in the decree. We see this a lot when parties represent themselves and do not have a lawyer watching out for their rights. We are here to help you through this hard and difficult time.Brooke Irey, Attorney Branch Family Law549 Heimer Rd., Suite 200 San Antonio, Texas 78232 (210) 229-2088 www.branchfamilylaw.comWe Want Your Good News!210.548.6448Submit Your Story To info@bsbhighlights.comJOIN US!Now Hiring Care GiversOur In-Home Care Services Brighten The Lives Of SeniorsWe are honored to have forged many friendships with our day-to-day assistance and companionship. For those of you who want your lives and businesses to make a difference, to touch others, to do something beyond yourself---become involved in your community. Get to know the character of our town. Join theChamber, a Network group, or a civic club! These organizations conduct several projects that make our town a better place to live, and they need your help. There are 120 to 200 people that meet monthly on the first Friday for Bingo at the Bulverde Civics Center. Volunteers are desperately needed to help with this event. Other community-wide opportunities are also available.A community focus by our citizens is noble and worthwhile. So, this year say “yes” to community involvement. Join your friends and neighbors to help make our town a better place to live.Dec. / Jan 2024-25www.bsbhighlights.com 11
